TERMS, CONDITIONS AND COPYRIGHT NOTICE

Description of Services, Prices & Fees

 

Proofs will be delivered no less than two days from the shoot. Once proofs are sent, images must be selected for edits within 30 days. Full-res images will be delivered through WeTransfer no later than one week from the time the edits are selected. There is a $100 fee for rush orders. Rush orders can be requested before or after the photoshoot. $100 only includes three images and will be completed within 24 hours. Proofs selected after 30 days will be $50 to edit. LucidLux is not responsible for lost or damaged images from 60 days after the photoshoot.

Copyright & Usage

 

An online gallery with high-resolution photos will be sent to the client no later than two weeks after the images are selected and edited. The gallery will be available for online viewing for 60 days. Clients will have the limited right to make and use copies of the digital images provided, for their own use in e-mail and on personal web pages. Clients will not authorize any reproductions of the images for commercial use or for the photographic competition.

Deposit and Cancellation

 

A deposit of half the session is due and payable at the time of booking. This holds the date and time of your session and is non-refundable. For any changes in dates or cancellations, LucidLux must be notified 48 hours in advance. The full amount for the session is due when canceling or postponing within the 48 hours of the shoot. LucidLux does not offer refunds. If you cancel within the 48-hours, we will reschedule your new appointment within the next 7 business days. If you cancel your appointment within 12 hours of your appointment, a $25 cancellation fee applies.

Payment

 

You may pay with Visa/Mastercard, AMEX or Cash, Paypal, Venmo. 

 

PayPal or Venmo payment will officially reserve the time slot. LucidLux does not accept eChecks.

Touch Ups

​

Touch Ups include clearing obvious blemishes such as acne and scars, Sharpening eyes, color correction, and some toning. All client-requested photographic touchups or alterations which are not included in the packages will only be performed at the client’s expense. Such retouching may include but is not limited to, correction of hair/makeup, environmental effects, clothing, removing reflections, wrinkles, special lighting effects, etc.

 

Legal 

 

Model Release: The Client hereby grants to LucidLux and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; to alter the same without restriction. The Client hereby releases LucidLux from any and all claims and liability relating to said photographs.

 

Failure to Perform: The photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the clients, or other principles. It is acknowledged that any lists submitted to LucidLux will be used for organizational purposes only and in no way represents photography that will actually be produced. LucidLux will do its best to fulfill all requests but can make no guarantees all images will be delivered.

 

Creative License: Images are edited at the photographer’s discretion, and delivered files may not include all images shot during a session. LucidLux reserves the creative right to edit and release only those deemed creditable as professional in quality and within the photographer’s artistic standards.

 

Indemnification: Client shall indemnify and hold harmless LucidLux from any loss, damage or liability resulting from Client’s violation of the terms of this Agreement or any agreement involving the Client and the LucidLux.

 

Independent Contractors: In providing services pursuant to this Agreement, the Parties shall be independent contractors, and no party to this Agreement shall make any representations or statements indicating or suggesting that any joint venture, partnership, or other such relationship exists between any of the parties except as set forth herein.

 

Contract

 

This Contract is valid with booking on www.lucidlux.us  with the payment of the deposit as specified by the Payment terms. This Contract incorporates the entire understanding between the Clients and LucidLux.

This Agreement is governed by the laws of the State of New York.
